TERMS AND CONDITIONS

 1.⁠ ⁠DEFINITIONS
1.1 Online Store – the e-commerce website available at https://qbuilds.ae, where the Buyer may purchase goods from the Seller.

1.3 Buyer – a natural person (18+) or a legal entity purchasing goods via the Online Store.
1.4 Privacy Policy – the document published on the Online Store regulating the collection, processing and storage of personal data.
1.5 Special Order – a desktop computer or other product assembled/configured specifically according to the Buyer’s requirements (custom build), or any other individually customized goods, as defined on the website or agreed with the Seller.
1.6 Agreement / Contract – the sale–purchase contract between the Buyer and the Seller, effective from the moment when the Buyer places an order in the Online Store and the Seller confirms it.
1.7 Parties – collectively, the Buyer and the Seller.
1.8 Terms – these Terms and Conditions for the Sale of Goods and Services, applicable to each purchase in the Online Store.
 2.⁠ ⁠GENERAL PROVISIONS
2.1 By ticking the “I agree to the Terms and Conditions” box and placing an order, the Buyer confirms that they have read, understood and agree to these Terms. These Terms then become binding between the Parties.
2.2 Only Buyers with legal capacity (and properly authorized representatives of companies) may purchase via the Online Store. By confirming the Terms, the Buyer declares that they have such capacity and authorization.
2.3 The Seller may amend these Terms at any time by publishing an updated version on qbuilds.ae. The Terms applicable to a specific order are those in force at the time the order is placed.
2.4 The Agreement between the Buyer and the Seller is deemed concluded when the Buyer completes the order process, confirms the order and receives electronic confirmation.
2.5 The Buyer is responsible for providing a valid email address and other contact details. The Seller may send all notices and documents electronically using these details.
 3.⁠ ⁠ORDERING GOODS
3.1 When placing an order, the Buyer must provide accurate data required for processing and delivery (name, surname, delivery address, email, phone number and any other relevant information). Data are processed according to the Privacy Policy.
3.2 Once the Buyer selects goods, adds them to the cart, completes the order steps and confirms payment, a binding Agreement is formed. The Buyer receives an order confirmation with a unique order number.
3.3 Orders are stored in the Seller’s system in accordance with the Privacy Policy and applicable UAE law.
 4.⁠ ⁠BUYER’S RIGHTS
4.1 The Buyer has the right to purchase goods via the Online Store in accordance with these Terms and UAE law.
4.2 The Buyer may cancel a Special Order within 24 hours of placing the order, unless otherwise agreed in writing. After this period, cancellation is generally not possible, as the goods are custom-built.
4.3 The Buyer may, subject to these Terms and provided the goods are not exempt, withdraw from the Agreement and return goods within 14 calendar days from the date of delivery, provided that:
the goods are unused, undamaged and in resaleable condition;
the original packaging (where possible) and all accessories are intact;
the goods have not been customized or specially built for the Buyer (Special Orders are usually excluded).
This 14-day return is a commercial policy of the Seller and does not limit any mandatory rights under UAE consumer protection law.
4.4 The Buyer may have additional rights under UAE legislation and the Privacy Policy.
 5.⁠ ⁠BUYER’S OBLIGATIONS
5.1 The Buyer must comply with these Terms and all applicable laws.
5.2 The Buyer must pay for the goods and accept delivery in accordance with these Terms.
5.3 If the Buyer, without valid reason, refuses to accept goods at delivery, the Buyer must compensate the Seller for any associated return, storage or re-delivery costs.
5.4 The Buyer must inspect the goods upon delivery. Any visible damage or discrepancies should be recorded with the courier and reported to the Seller as soon as possible.
 6.⁠ ⁠SELLER’S RIGHTS
6.1 The Seller may temporarily or permanently suspend the operation of the Online Store for maintenance, updates or other reasons.
6.2 The Seller may change product range, descriptions, prices and other information in the Online Store at any time.
6.3 If the Seller suspects misuse, fraud or breach of these Terms by the Buyer, the Seller may restrict or block the Buyer’s access to the Online Store.
 7.⁠ ⁠SELLER’S OBLIGATIONS
7.1 The Seller undertakes to provide access to the Online Store and enable the Buyer to purchase goods as per these Terms.
7.2 The Seller undertakes to deliver the goods to the address specified by the Buyer using the chosen delivery method.
7.3 If the Seller cannot deliver the ordered goods due to unforeseen circumstances (e.g. supplier issues), the Seller may cancel the order after notifying the Buyer and will either offer alternatives or refund all payments within 14 calendar days.
7.4 If the Buyer cancels a Special Order within the allowed 24-hour period, the Seller will refund all payments within 14 calendar days, unless another arrangement is agreed.
7.5 The Seller may withhold refunds until the goods are returned and inspected, except where goods were never delivered.
7.6 The Seller undertakes to provide clear and accurate information about goods, pricing, and key characteristics, as required by UAE consumer and e-commerce regulations.
7.7 The Seller undertakes to respect the Buyer’s privacy and to process personal data only as described in the Privacy Policy and applicable UAE data protection laws.
 8.⁠ ⁠PRICES AND PAYMENT
8.1 All prices in the Online Store are shown in AED and, where applicable, include UAE VAT (5%).
8.2 Available payment methods include (depending on what you actually support):
Credit/debit card (VISA, Mastercard, etc.);
Local online payment gateways;
Bank transfer (details shown on the invoice or checkout);
Installment/financing via third-party providers (if available).
8.3 The chosen payment and delivery methods, along with any applicable fees, are shown at checkout.
8.4 By agreeing to these Terms, the Buyer agrees that invoices and other documents may be sent electronically to the email address provided.
8.5 Some prices and stock levels may depend on third-party suppliers. If pricing or stock errors make it impossible to fulfill an order on the displayed terms, the Seller may:
offer alternative or similar goods, or
cancel the order and refund all payments.
8.6 The Seller may set a minimum order value and charge an administration fee for smaller orders. Any such fee will be clearly displayed at checkout.
 9.⁠ ⁠DELIVERY
9.1 The Buyer must provide a full and accurate delivery address within the UAE (unless international shipping is explicitly offered).
9.2 After payment is received, the Seller confirms the order and arranges shipment. The Buyer is notified by email and/or SMS when the order is dispatched.
9.3 Goods may be delivered:
by courier to the specified address, or
by collection from a designated pickup point or the Seller’s premises (if this option is offered).
9.4 The Seller ships working, undamaged goods that match their description. If goods are damaged in transit, claims will generally be handled through the delivery company, but the Seller will assist the Buyer with the process.
9.5 Delivery times shown in the Online Store are indicative. Delays may occur due to logistics, customs, or other external factors.
9.6 The Seller is not responsible if product colours or other aspects differ slightly from what appears on the Buyer’s device due to screen settings.
10.⁠ ⁠WARRANTIES
10.1 Goods are covered by the manufacturer’s warranty and, where applicable, by any additional commercial warranty provided by the Seller, as indicated on the product page or invoice.
10.2 During the warranty period, defects due to manufacturing faults will be repaired or the goods replaced in accordance with the warranty conditions and applicable law.

10.4 The Buyer must provide proof of purchase (invoice) and, if available, a warranty card.
10.5 Statutory rights under UAE law are not limited by any commercial warranty.
11.⁠ ⁠RETURNS AND CANCELLATIONS
11.1 Returns for defects and cancellations within the contractual 14-day period are handled in accordance with these Terms and UAE law.
11.2 If goods are defective, the Seller will repair, replace or refund them, depending on the nature of the defect and legal requirements.
11.3 For non-defective goods, a return may be accepted within 14 calendar days, subject to the conditions listed earlier (unused, undamaged, resaleable, not a Special Order, etc.).
11.4 Refunds are made using the same payment method used for purchase, unless otherwise agreed, within 14 calendar days from approval of the return.
11.5 Certain goods are non-returnable, including:
Custom-built (Special Order) computers and components;
Sealed items unfit for return if unsealed (for hygiene or safety reasons);
Software, digital licenses or downloadable products once activated or downloaded.
12.⁠ ⁠PERSONAL DATA AND PRIVACY
12.1 The processing of personal data is governed by the Privacy Policy available at qbuilds.ae.
12.2 By accepting these Terms, the Buyer acknowledges that they have read and understood the Privacy Policy.
13.⁠ ⁠LIABILITY
13.1 The Buyer is responsible for the correctness of all information provided when using the Online Store and placing orders.
13.2 The Seller is not liable for improper performance of obligations if caused by inaccurate or incomplete data provided by the Buyer.
13.3 The Seller is not responsible for third-party websites accessed via links on the Online Store and does not control or endorse their content.
13.4 The Seller is not liable for minor differences in colour or appearance of goods due to screen or device settings.
13.5 The Seller is not liable for failure to perform or delayed performance due to force majeure circumstances (see clause 15.6).
14.⁠ ⁠COMMUNICATION
14.1 “In writing” includes email.
14.2 The Buyer may contact the Seller regarding orders, returns, complaints or other matters at:
info@qbuilds.ae or service@qbuilds.ae (if you use a separate service address).
14.3 The Seller will send all important notifications to the email address or phone number provided by the Buyer.
15.⁠ ⁠FINAL PROVISIONS
15.1 These Terms are governed by the laws of the United Arab Emirates and, where applicable, the laws of the Emirate of Dubai.
15.2 Any Agreement between the Buyer and the Seller is formed and interpreted based on these Terms and the documents referred to herein.
15.3 Disputes should first be resolved amicably through negotiation.
15.4 If no settlement is reached, disputes shall be submitted to the competent courts of Dubai, UAE, unless mandatory consumer protection rules require another forum.
15.5 Consumers may also file complaints with the relevant UAE consumer protection authority (e.g. Dubai Economy and Tourism – Consumer Protection).
15.6 The Parties are excused from liability for non-performance caused by force majeure events beyond their control (such as natural disasters, war, government acts, major network outages), as defined by UAE law.
